Everyone who swears an oath to uphold the Constitution, and doesn’t, has committed two crimes, Perjury, and Treason. Perjury is punishable by prison, Treason, by death.

 

Now lets see what is left of the Bill of Rights…

 

1st Amendment Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

 

Our founders could have done us all a big favor by cutting this off after “Congress Shall make no law.” Just put a period at the end and we would all be a lot better off if you ask me.

 

“respecting an establishment of religion or prohibiting the free exercise thereof”

 

Well, 50 some odd years so ago, LBJ “offered” churches 501c3 tax exempt status. Which might sound great except that churches weren’t taxable prior to that arrangement. Why do such a thing? A Couple of reasons, now the government gets to decide if you are in fact a church and need to pay taxes or not. Secondly, 501c3 exempt organizations cannot speak out on certain political topics and keep their tax exempt status. So if your pastor, preacher, priest, rabbi or whatever, speaks out for example against a candidate who is in favor of abortion or war, know that this man is risking his livelihood to bring you his views, as it is now illegal for him to do so.

 

“or abridging the freedom of speech”

 

Well, let’s see how much speech is still protected. If I were to quote the founding fathers, would I be guilty of a crime in America? Under US Code 2385 “Advocating Overthrow of Government” I would be, it reads in part, as follows.

 

“Whoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein, by force or violence, or by the assassination of any officer of any such government” It goes on to describe membership of any group (right of the people to peaceably assemble?) who advocates such overthrow, and hold prison sentences of up to 20 years. You really have to love the “teaches the duty” part because this is an obvious attack on teaching the Declaration of Independence, I quote…

 

“Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn that mankind are more disposed to suffer, while evils are sufferable than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.”

 

Well, when the government decided over 70 years ago that the 10th Amendment didn’t actually limit their powers, and started passing law after law after law restricting the people and violating their rights, is that now a long train of abuses and usurpations?

 

Is our government pursuing invariably the same object, when every day they work towards raising our taxes and taking away our liberty?

 

Does the Obama Administration evince a design to reduce us under absolute despotism, when instead of having regulations reviewed by Congress and people who have been confirmed by congress, he enlists 30 something “Czars” to go into private industry and hand out orders on how to act?

 

If so, is it our right? Is it our duty, to throw off our government and find new guards for our future security? I guess for me to say yes would be punishable by up to 20 years in prison.

 

They stuck this in Chapter 115 “TREASON, SEDITION, AND SUBVERSIVE ACTIVITIES” Which is another direct violation of the Constitution. Article 3 Section 3 outlines Treason.

 

Section 3 - Treason

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

 

So there needs to be some overt act, and at least two witnesses to it. Under the Constitution, I can preach the duty, necessity, desirability, or propriety of overthrowing or destroying the government all day long, god knows Thomas Jefferson did it all the time.

 

He said quote,

 

“"God forbid we should ever be twenty years without such a rebellion. The people cannot be all, and always, well informed” He goes onto say

 

“And what country can preserve its liberties, if it's rulers are not warned from time to time, that this people preserve the spirit of resistance? Let them take arms.” And continues to say

 

“The tree of liberty must be refreshed from time to time, with the blood of patriots and tyrants. It is its natural manure."

 

I could spend all day with such quotes, and with other violations, but lets move forward.

 

“or of the press” I’ll go further into this another time, but if we consider radio and television media to be within the modern meaning of “the press”, who decides who gets a radio or television station? The FCC! Federal Communications Commission. They get to decide what is “obscene”, they can hijack any radio transmission in America with the touch of a button, is that a free media?

 

“or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.” Has anyone ever been to a protest where the police DIDN’T show up?

 

Second Amendment “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

 

In 1791 “Well Regulated” meant Well prepared, that’s where we get the term “Minute Men” you had to be ready to go at a moments notice.

 

It doesn’t say anything about a national guard. Besides that, it doesn’t say “necessary to the security of a free State, so we will let the people keep and bear Arms.” It Says “The Right of The People to Keep and Bear Arms Shall Not Be Infringed” It Doesn’t say, “Shall not be abolished” it says “Shall not be INFRINGED” They acknowledged that we have the right to arm ourselves, and to carry our weapons with us.

 

Therefore EVERY gun law in existence including taxes on weapons are fully unconstitutional and a violation of our CIVIL RIGHTS.

 

3rd Amendment, “No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.” probably the only one I haven’t personally witnessed violations of, but it has been violated during every war on American soil, I’ll let you look it up if you so desire.

 

4th Amendment, The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

 

Then what is a “Sobriety Checkpoint” or better yet, “Click it or Ticket” checkpoint.

 

What is it when every year the Federal Government says if I don’t tell them about all the money I made, they will come put me in prison?

 

What is it when I refuse a search of my vehicle, so the officer detains me and gets a drug dog to sniff around for probable cause?

 

And if the police obtain a warrant to search for some sort of drugs somewhere in a house, is that is that particularly describing the place to be searched and things to be seized? If they come in with that warrant, then break all the drywall down looking for heroin in my walls, but don’t find any are they charged with perjury? NO!

 

5th Amendment, No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

 

If I can be sentenced to up to a year in jail, incur thousands of dollars in fines, and be forced to hire a lawyer, without an indictment on a misdemeanor, how much in effect would you say this is? Think it can’t happen, get a DWI.

 

“nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb” If a person is suspected of burglarizing a home, they will be charged with both burglary, and larceny, and if he broke a window, criminal mischief. If a person is arrested for DWI, they will be charged twice, either With DWI and DWI Per Se (BAC Limits) or DWI and Chem Test Refusal, the list goes on and on. Sounds like double jeopardy to me.

 

“nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law”

 

If the police question me while I have a gun to my head, is that being compelled?

 

In DWI, Drug, and other cases, property is often seized either as a profit or instrumentality of the crime. In the case of a DWI the drivers vehicle will be seized at the time of arrest, and a “Civil” hearing separate from their criminal prosecution commences. Defendants are denied counsel, and questioned about their accusations, and threatened to have their vehicles forfeited if they don’t answer questions, sounds pretty compelling to me, and hardly sounds like due process of law before taking property, especially since a verdict of “Not Guilty” in criminal court doesn’t get you your property back.

 

6th Amendment, In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

 

If the District Attorney waits a year to prosecute me for an accusation, do I have a speedy trial?

 

If the government and special interest groups run propaganda campaigns in the media, in an effort to change people’s behavior, then I go into court before a jury filled with lies they heard on tv, is that an impartial jury?

 

If the only “Counsel” I am allowed to hire, is a lawyer licensed by the same system which seeks to destroy me, do I really have “Counsel” at all?

 

7th Amendment, In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.

 

Michael Badnarik has a great video series on the Constitution that talks about this in more detail, but you’re almost never in a “Common Law” court. This has been translated by some to “Right to trial by jury in civil cases” Well, have you ever had a “Civil” traffic ticket? I mentioned before the “Civil” proceeding in seizure laws, no juries there, just a judge whose job is simply to take your money and property.

 

8th Amendment, Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

 

If $2500 or more is excessive bail for a traffic infraction, or $10,000 or more in fines and surcharges are excessive fines, and I would submit that they are, then one need look no further than any Monday morning arraignments session in any criminal court in America to find violations of this.

 

If forced medical treatment is cruel or unusual, or if putting a drug addict in prison for a decade simply for possession of the drug to which they are addicted is, and I would submit to you that they are, one need look no further than a “drug court” to find these examples.

 

9th Amendment, The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

 

One of the reasons the Bill of Rights was not enumerated until after the Constitution was ratified was because the founders were afraid, and rightfully so, that enumerating rights in the Constitution would basically give the government carte blanche to violate every other right you had. Things like, the right of a man and a woman to marry, well, if they have a RIGHT to marry, then why do they need a marriage License? Nobody ever thought you would need to tell a government that people had the right to marry, any more than they thought you would need to tell a government that you had a right to travel, but then why do I need a drivers LICENSE?

 

“Well, because they didn’t know that we would have cars, and cars are dangerous” well, maybe not, but they knew we had horses, and do you really think in modern day America, we’d be any safer if we were all riding horses down the LIE in rush hour traffic? For that matter, do you think I can just go buy a horse and start riding it around without the government getting involved? Think again.

 

I have gone over the 10th Amendment so many times I won’t even bother. Our government operates so far outside its Constiutional Authority, it is terrifying.

 

Now that we have lost all hope for the Bill of Rights, lets see what we have in the way of the Communist Manifesto, perhaps there is some hope here.

 

In 1848, Karl Marx and Frederick Engels wrote the Communist Manifesto, which explains the basic idea of a communist society and it outlines ten conditions for a transition to communism, commonly known as the 10 planks, I submit to you that 10 of these 10 are in effect in America right now.

 

First Plank: Abolition of property in land and the application of all rents of land to public purposes.

 

What do you think zoning laws, and property taxes are?

 

Second Plank: A heavy progressive or graduated income tax.

 

(Corporate Tax Act of 1909. The 16th Amendment, allegedly ratified in 1913. The Revenue Act of 1913, section 2, Income Tax. These laws have been purposely misapplied against American citizens to this day.)

 

Third Plank: Abolition of all rights of inheritance.

 

What is “Estate Tax” “Death Tax” “Inheritance Tax” on your privilege of inheriting?

 

Fourth Plank: CONFISCATION OF THE PROPERTY OF ALL EMIGRANTS AND REBELS.

 

Try getting on a plane some time with more than $10,000, and see how far you get.

 

The police seize vehicles for DWI and all types of things from drug dealers, what do you think they do to those accused of treason?

 

Fifth Plank: Centralization of credit in the hands of the State, by means of a national bank with State capital and an exclusive monopoly.

 

Federal Reserve, bank bailouts buying a controlling interest in the banks anybody?

 

Sixth Plank: Centralization of the means of communications and transportation in the hands of the State.

 

What is the Federal Communications Commission? What is the Department of Transportation? What is The National Highway Traffic Safety Administration?

 

Seventh Plank: Extension of factories and instruments of production owned by the State, the bringing into cultivation of waste lands, and the improvement of the soil generally in accordance with a common plan.

(Depart-ment of Agriculture, 1862; Agriculture Adjustment Act of 1933 -- farmers will receive government aid if and only if they relinquish control of farming activities; Tennessee Valley Authority, 1933 with the Hoover Dam completed in 1936.)

 

Eighth Plank: Equal liability of all to labor. Establishment of industrial armies especially for agriculture.

 

(First labor unions, known as federations, appeared in 1820. National Labor Union established 1866. American Federation of Labor established 1886. Interstate Commerce Act of 1887 placed railways under federal regulation. Department of Labor, 1913. Labor-management negotiations sanctioned under Railway Labor Act of 1926. Civil Works Administration, 1933. National Labor Relations Act of 1935, stated purpose to free inter-state commerce from disruptive strikes by eliminating the cause of the strike. Works Progress Administration 1935. Fair Labor Standards Act of 1938, mandated 40-hour work week and time-and-a-half for overtime, set "minimum wage" scale. Civil Rights Act of 1964, effectively the equal liability of all to labor.)

 

Ninth Plank: Combination of agriculture with manufacturing industries, gradual abolition of the distinction between town and country, by a more equitable distribution of population over the country.

 

(Food processing companies, with the co-operation of the Farmers Home Administration foreclosures, are buying up farms and creating "conglomerates.")

 

Tenth Plank: Free education for all children in public schools. Abolition of children's factory labor in its present form. Combination of education with industrial production.

 

(Gradual shift from private education to publicly funded began in the Northern States, early 1800's. 1887: federal money (unconstitutionally) began funding specialized education. Smith-Lever Act of 1914, vocational education; Smith-Hughes Act of 1917 and other relief acts of the 1930's. Federal school lunch program of 1935; National School Lunch Act of 1946. National Defense Education Act of 1958, a reaction to Russia's Sputnik satellite demonstration, provided grants to education's specialties. Federal school aid law passed, 1965, greatly enlarged federal role in education, "head-start" programs, textbooks, library books.

 

And there you have it. We have replaced the Bill of Rights with the Communist Manifesto. That is where voting Democrat or Republican has gotten us.

Saving America By Way of Repealing Laws

 

Politics today are so diluted by people seeking only to amass power into the highest levels of government. Every politician seems to want to pass some law or other which he or she thinks is going to make your life better. But I have a better idea, repealing laws that make your life worse.

  • Repeal the 17th amendment.

When We The People originally created the Constitution, there was a Senate and a House of Representatives, the Congressmen inside the House of representatives were elected Democratically within their districts, they represented the people, the Senators were elected by the State Legislatures and Represented the State Governments. In 1913 we allegedly ratified the 17th Amendment, which makes Senators elected democratically by the people. Which might sound great to those who want to live in a Democracy, personally, I  think that Article 4, Section 4 of the Constitution of the United States of America says "The United States shall guarantee to Every State in this Union a Republican form of Government" and the Pledge of Allegiance says "And to the Republic for which it stands". We (theoretically) live in a Constitutional Representative Republic, and taking representation away from the State Governments is the most damaging thing we can do to that form of Government.

  • Drastically cut spending, without ending entitlements.

Every Presidential Candidate I have ever seen speaks of this, none seem to ever do it in a meaningful way, when your representatives speak of cutting spending, ask them what they will cut. I have a few ideas of my own.

  • Abolish the United Stated Department of Agriculture.

We spend about 95 Billion Dollars a year on the USDA, the purpose of the USDA is more or less to say "Grow Plants This Way" and I simply don't think this warrants that kind of spending.

  • End US Foreign AID (USAID).

I simply cannot come to any reasonable conclusion as to what purpose it could possibly serve to ship 88.5 Billion Dollars a year out of this country during the worst economic crisis in history, without getting anything in return. These funds are all too frequently abused, taken by warlords or dictators to buy weapons or feed soldiers, and would be much better handled by private charities.

  • Abolish the US Commerce Department.

Why spend $8.2 Billion regulating commerce? Free markets fix themselves, get the government out of it, and save 8.2 Billion dollars in the process.

  • Abolish the US Department of Education.

I personally oppose public schools at all levels, I cannot think of anything worse than the government educating the youth. But ending the US Department of Education doesn't do that, for all you people who think Public Schools are a good thing. We spend about 64 billion dollars on the US Department of Education Each year. For that $64 billion, what do you get? You get high school graduates who cannot read, do not know anything about the Constitution, think we live in a Democracy, and don't know what communism is except to say "USSR?"

  • Abolish the Environmental Protection Agency.

If the environment is so bad, that the Democratic party thinks we are in such an emergency, that we must pass a radical policy like Cap & Trade, then how much has the EPA done to deserve it's nearly $8 Billion budget? In my opinion, absolutely nothing.

  • Abolish the Department of Energy.

How much good has the Department of Energy done for you with it's 24.7 Billion dollar budget, if your gasoline is now $2.89/gallon on a good day, and nuclear energy is taboo in the US but all the rage in the countries who have all the oil? Absolutely nothing, end it.

  • Remove Medicare and Medicaid from Health and Human Services, then Abolish HHS.

The budget for HHS is $736.8B, Medicare is $420B, Medicaid is $223B leaving 93.8 Billion dollars to disseminate information. Information like "There is no medical purpose for marijuana" even though 13 states have passed some kind of medical marijuana legislation in defiance of federal law. In this day and age, people have no shortage of means by which to find information, Internet, Television, Radio, Print Media, and social interaction will fill the gap easily, there is no purpose for a government agency telling the people how to be healthy.

  • Abolish the US Department of Labor

What purpose could it possibly serve to spend 54.2 Billion dollars a year regulating labor? Thats approximately $180 per person per year telling private corporations how to treat their employees who work there voluntarily, and essentially telling laborers "Lift heavy things this way". It is a ridiculous concept, it isn't working, and it is a waste of money.

  • Abolish the National Science Foundation.

Science is promoted by private industry, not government, so why spend $6.4 Billion on the National Science Foundation?

  • Remove the Federal Aviation Administration from the Department of Transportation, then Abolish the Department of Transportation.

The DOT Budget is $71.1 Billion, The FAA Budget is $14.6 Billion, Leaving 56.5 Billion Dollars to run a failing railroad system, a Federal Agency that mandates traffic local Traffic Laws, and regulates automobile manufacturers (That worked out real good didn't it?). STOP!

  • Abolish the Drug Enforcement Agency

Every year the DEA seems to find itself needing more and more money, to fight a war on drugs that makes a curious 14 year old an enemy combatant. It is up to 2.6 Billion Dollars. And how much good have they done to end the drug trade? Ask your local drug dealer, I'm sure you have one. At this very moment, just about anybody could go out to any bar in America, and ask a few people for drugs, and one of them would be able to supply drugs. Charles Manson was caught selling drugs in one of Americas most secure prisons. Whether you want drugs legalized or not, it doesn't make any sense at all to spend $2.6 billion dollars on an agency that has utterly failed to do anything meaningful to end the drug trade in America.

  • Abolish the Bureau of Alcohol Tobacco and Firearms.

Alcohol Tobacco and Firearms are all perfectly legal, and one of them is supposed to be protected from any form of infringement by the Constitution of the United States of America. So why spend $1.1 Billion on an armed agency running around making sure people are doing what they are told with perfectly legal, and constitutionally protected things? It just doesn't make any sense.

Thats over half a trillion dollars a year, without ending entitlements, without cutting defense, and without cutting any meaningful law enforcement. This is before you bother cutting waste, fraud and abuse from any other program.

Just by not telling private citizens and businesses what to do, I saved half a trillion dollars a year, and I did it in a couple of hours. Continue cutting spending, take not a scalpel to the Federal Budget, not a Hatchet, but a flame thrower. Find $1 Trillion in cuts.

  • Don't cut taxes. Pay back the Federal Reserve, and End it. Pay back foreign debt, then stop borrowing.

 

  • Repeal the 16th Amendment and End the IRS. DO NOT REPLACE IT WITH A FEDERAL SALES TAX!

Ending the IRS Saves another 10.4 Billion dollars, gets the Federal Government off the backs of the people, and eliminates the most tyrranical, heartless, and wasteful of agencies in the history of the world.

  • But don't cut taxes. What? Thats right, don't cut taxes.

The Federal Government can still lay taxes to the states, based on the Census, and they should, we need a military for example. Your state can send you the bill in the form of income tax, or it can drill for oil, whatever it wants to do to pay the Federal Government. If you don't like your state's tax policies, you can move to another state.

But why keep tax rates the same? To reverse the spending habits of the government. Allow the government to build a surplus of one years spending, then spend it. After that, the Federal Government must (in peacetime) spend only that which it collected the year before, rather than spending whatever they please and then taxing to get it back. Take away their credit card, and give them a debit card instead. They can only spend what they have, except in times of war.

  • Now, cut taxes, drastically.

See how much the lives of the American People improve when half their money isn't going to the Federal Government, when the Federal Government isn't paying millions of dollars a day in interest on deficit spending, when the Federal Government isn't counting every dollar they earn and spend. The effect would be absolutely breathtaking and this would be real change for the better.

Businesses, unburdened by overregulation and Communist style tax policies will flourish, Foreign businesses, seeking relief from the tax policies and regulations of their current country of origin will flock here in droves, US businesses who offshore their assets, or have left America altogether will return, and unemployment will virtually end, for those willing and able to work anyway.

Doctors and hospitals, unburdened by harsh taxes on their deservedly high incomes, will pass their savings on to patients, Medicine, no longer burdened by high taxes and FDA regulation, will become cheaper, and health insurance costs will drop to affordable levels.

With business thriving, medical treatment affordable, and unemployment a result of only laziness or disability, you can now begin to cut entitlement programs, further reducing tax burdens, and rewarding Americans for work instead of enslaving them under the disguise of free food, water, shelter, and medicine.

We will once again be a free people.
